2. Client Responsibilities

To ensure success, you agree to:

Provide accurate and timely information required for campaign developmentReview and approve content, creative, or strategy in a timely mannerRespect timelines, payment terms, and cooperation standards outlined in the agreement

Delays due to lack of response or assets from the client may affect timelines and delivery.

3. Fees and Payments

All services are billed according to your custom agreement or selected service plan. Payment terms are as follows unless otherwise stated:

Invoices are due upon receiptLate payments may incur a 5% monthly feeProject work may pause if payments are delayed

We accept payment via credit card, ACH transfer, or bank wire. Any transaction fees incurred are the responsibility of the client.

4. Refunds and Satisfaction Guarantee

We stand behind our service. If you are unsatisfied, we offer a

14-day satisfaction guarantee

. Refund eligibility is limited to services not yet delivered or used. All refund requests must be submitted in writing to

within 14 days of payment.

Custom work or digital assets already delivered are non-refundable.

5. Intellectual Property

Unless otherwise agreed, all assets created by The Prospect Syndicate during the project — including ad creative, funnels, and strategy documents — remain the property of The Prospect Syndicate until full payment has been received. Upon final payment, ownership transfers to the client, except for licensed content or third-party assets.

We reserve the right to showcase work in our portfolio unless a written NDA prohibits it.

6. Confidentiality

Both parties agree to keep all sensitive business, marketing, and customer information confidential. This includes (but is not limited to) customer lists, strategy documents, campaign data, and proprietary tools or frameworks.

7. Performance Disclaimer

While we use industry-leading practices, tools, and strategies,

we do not guarantee specific results

(e.g., revenue, traffic, or conversion numbers). Marketing outcomes can vary based on your industry, offer, competition, and implementation of our recommendations.

8. Use of Website

By accessing our site, you agree not to:

Copy or resell our content or strategyDisrupt or harm the site’s function or securityUpload malicious code or spamUse our site for illegal or unauthorized purposes

Violations may result in suspension or permanent ban from our services.

9. Third-Party Tools and Services

We may use third-party software, platforms, or vendors to deliver our services (e.g., Facebook Ads, Google Analytics, ClickFunnels, Mailchimp, etc.). You agree to their separate terms and understand that The Prospect Syndicate is not liable for issues arising from third-party platforms.

10. Limitation of Liability

To the fullest extent permitted by law, The Prospect Syndicate shall not be liable for any indirect, incidental, or consequential damages — including lost profits, revenue, or data — arising out of or in connection with our services.

Total liability shall not exceed the amount paid for the services in question.

11. Termination

Either party may terminate the service with written notice. In the case of termination, you are responsible for payment for all work completed up to the termination date. We may also terminate services immediately if terms are violated.
